Buying property as a new arrival
Jersey property divides into qualified and unqualified, and which one you may buy is decided by your residential status rather than by your budget.
The distinction that governs everything
Jersey property is qualified or unqualified, and which you may occupy is decided by your residential status, not by what you can afford.
Qualified property is the ordinary housing stock. Permanent Entitled and Entitled holders may buy and sell any of it; a Licensed holder may buy or rent one property and must live in it; Entitled for Work Only holders can buy only in limited cases, through an eligible partner; Standard status carries no right to buy at all. gov.je’s status table sets out each. Unqualified — usually called registered — property is what is available to everyone else, and it is a smaller pool.
For most people arriving without status, buying is not the immediate question. Establishing which status you hold, and when you might hold a different one, is.
Conveyancing through the Royal Court
Jersey property does not change hands the way English property does. Contracts are passed before the Royal Court — share transfer flats, which complete by transfer of shares, are the exception — and only a Jersey advocate or solicitor can present the contract.
The Court sits for property on Friday afternoons. That gives transactions a weekly cadence rather than a continuous one, and it means a deadline missed is a week lost rather than a day. Instruct early and do not assume an English-style timetable.
Jersey also has its own property law traditions, including flying freehold and share transfer ownership for many flats. Share transfer in particular behaves differently from freehold on financing, on service charges and on resale — ask your advocate to explain what you are actually buying before you offer.
Costs
Stamp duty applies on a rising scale and is a serious figure at higher values. Legal fees, search costs and, for share transfer purchases, the costs specific to that structure sit on top.
Confirm current stamp duty rates with gov.je rather than relying on a third-party summary. This is exactly the kind of figure that changes and then persists in outdated form across the internet.
Before you offer
Rent first. Almost everyone who buys straight off the plane regrets the parish rather than the house. A year renting is cheap insurance.
Establish the status position properly. Nothing about a purchase works if the status underneath it does not.
See the property in winter, or ask someone who has. Granite buildings, coastal exposure and rural darkness are all much more real in January.
